Questions families often ask

How is matrimonial property divided in Malaysia?

Malaysian courts consider what each party contributed — financially and otherwise — over the course of the marriage. The family home, joint savings, and any business held jointly are all assessed. The result varies considerably depending on the length of the marriage, any children involved, and the circumstances of each spouse. The office prepares a clear schedule before any negotiation begins so both sides can see the picture.

Can relatives apply for guardianship of a child they are already caring for?

Yes. Relatives who have been looking after a child informally — grandparents, aunts, uncles — can apply to have the arrangement placed on a proper legal footing. The court will consider the welfare of the child and will wish to understand the circumstances. The office will explain what is involved and what the court is likely to ask before anything is filed.

What happens at the advice meeting?

The meeting is typically an hour. The client describes their situation and the solicitor asks clarifying questions. There is no obligation to instruct the office for further work. Within five working days, a short written note is delivered setting out the client's legal position and the routes that are available — written so that it can be read alone or shared with a trusted family member.

How long does an adoption take?

Applications typically take between five and twelve months from filing to the court order. Much of that time is waiting — for welfare reports, for consents to be filed, for a hearing date to be assigned. The office will explain which stages require active work and which are periods of waiting, so families can plan accordingly.

Are the fees fixed or could they change?

The fees quoted on this site are the office fees for the service described. Disbursements — court filing fees, valuer charges, stamp duty — are not included in those figures and will be stated separately before they are incurred. The office does not add charges that have not been discussed.

Is what I share with the office kept private?

Yes. Solicitor-client privilege applies to all communications. The office will not discuss a client's matter with any other party — including other family members — without instruction to do so. This applies from the first contact.
